This Committee builds on John Barrett’s innovative concept from the Institute’s First Annual Conference that international trade, commerce and investment would be improved and enhanced if there were procedures in place that would facilitate multinational business obtaining reorganizational financing in cross-border cases.
The procedures could take the form of such things as standardized contractual provisions in lending and credit transactions, or a set of rules promulgated by the Institute that could be included by reference in transactional documentation, or guidelines that could be incorporated into the current UNCITRAL process or even draft legislative language. The essential goal of the project is to devise equitable and efficient systems that would permit reorganizational financing to be raised fairly and efficiently in the context of a financial restructuring of a multinational business enterprise.
